PRINCIPLES OF ENFORCEMENT PROCEEDING

Abstract

The enforcement proceeding is one of the relatively young and dynamically developing branches of the Russian legal system, it requires a constant and indepth development of scientific theorizing about the nature, content of its legal norms and legal mechanisms based on its principles. First of all, the principles of enforcement proceedings follow from general legal principles that reflect economic, political, social processes and dictate the need for the overall development of this branch of law. The consistent development of the doctrinal approach, correct and well-timed legislative influence on social relations in the field of compulsory enforcement makes it necessary to take into account the specific features of the judicial acts implementation, as well as acts of other bodies and other officials. Enforcement proceedings in this regard are considered as one of the tools to ensure the effectiveness of the enforcement system.
