TO THE QUESTION OF THE ORIGIN THE STATE AND LAW THEORIES

In this article, the author analyzes the place of theories of the state and law origin in the subject of science of the theory of state and law. Noting the diversity of such theories, the author gives an idea that these theories are more of an ideological and conceptual justification for the emergence of the state than an analysis of the real historical process. Further, a critical analysis of the theories of the state and law origin significance and validity is given and it is concluded that it is necessary to take into account, first of all, the laws of historical development, facts and documents that have influenced this process. In conclusion, the concept of the term «the theory of the origin of state and law» is given.
