SOME ISSUES OF CRIMINAL PROCEEDINGS RESUMPTION IN VIEW OF NEW CIRCUMSTANCES

The article, taking into account the changes made to the criminal procedure law in 2022, analyzes such grounds for resuming criminal proceedings due to new circumstances, such as rulings of the Constitutional Court of the Russian Federation and decisions of the European Court of Human Rights. The procedure for the the case resumption on these grounds is disclosed, including where there is still a need to bring the judgement accoding to the position of the European Court of Human Rights, as well as the conditions under which the Presidium of the Supreme Court of the Russian Federation decide on annulment or modification of the court decision in order to bring it into conformity with the positions of the Constitutional Court of the Russian Federation and the European Court of Human Rights. The practice of rendering decisions by the Presidium of the Supreme Court of the Russian Federation on the resumed proceedings in 2022 is analyzed.
