INTEREST AS THE BASIS FOR LEGAL-COMPLIANCE IN THE CRIMINAL SPHERE

Interest is a prerequisite for many social relationships. It can lead to action or inaction. Actions or inactions that are prohibited by law become the focus of a legal relationship. In the criminal sphere, they are treated as illegal compliance and receive legal assessment of the law-enforcer. Legal-compliance (legal compliance) and discretionary compliance form the basis of criminal procedural relations aimed at ensuring procedural rights and investigating the circumstances of unlawful compliance. Purpose: to analyse the features, attributes and types of legal-compliance in criminal law and criminal procedure, to formulate definitions and classifications concerning the new legal phenomenon. Methods: empirical methods of comparison, description, interpretation; theoretical methods of formal and dialectical logic; private-scientific methods: legal-dogmatic and interpretation of legal concepts. Results: the concept of legal compliance is formulated, its types, main elements of the new legal institution are defined.
