SOCIAL PROTECTION OF FAMILIES WITH DISABLED CHILDREN WITHIN THE SOCIAL RISK CONCEPT

The proclamation of 2024 as the Year of the Family in the Russian Federation causes increased attention to the social protection of families, primarily families with children. Such protection is based on the provisions of the Constitution of the Russian Federation, which enshrine a set of social rights, including the right to the protection of motherhood and childhood, family, social security and education. The purpose of this article is to study the social protection of families with disabled children from the perspective of the social risk concept. The concept is based on the need to organise a social protection system taking into account the specific social risks to which some categories of population are exposed. Differentiation of social protection and its legal regulation is carried out on objective and subjective criteria reflecting the characteristics of social risk. As a result of the study, it was concluded that one of the categories of the population for which special social protection measures are established is the family as the most human-like social institution. Further differentiation is carried out within this category and families with children are singled out primarily as the addressee of social protection. In turn, families with disabled children are singled out among others. Their protection from any social risks caused primarily by the ill health of children and the need to care for them is complex. Defects in legislation and the practice of its application are overcome, among other things, on the basis of decisions of the Constitutional Court of the Russian Federation, the analysis of which can also be built in line with the concept of social risk and its postulates such as equal protection from risk of the same nature and degree, taking into account the dynamics of social risk, the adequacy of legal assessment of such risk, etc.
