ON THE LEGAL REGULATION OF DISABLED EMPLOYMENT

The article is devoted to the study of federal and regional labor legislation regulating issues related to the employment of such category of citizens as disabled, as well as an analysis of such a current problem as unjustified refusal by the employer to hire a disabled person. The realization by citizens of the constitutional right to work, its legal protection is of great theoretical and practical importance for strengthening the legality and stability of labor relations. Purpose: to identify issues in the legal regulation of employment for individuals with disabilities and formulate solutions. Methods: to achieve this purpose, general scientific methods, as well as specialized methods (systemic-structural, formal-legal, and comparative-legal methods) are used. Results: a conclusion has been reached regarding the need to supplement the Russian Federation Labor Code with a special chapter “Specifics of regulating the labor of disabled persons” which will, firstly, clarify the corresponding legal status of this category of workers at the federal level and, secondly, regulate such legally complex issues as, for example, establishing a quota for hiring disabled persons, determining the grounds for refusing to hire a disabled person and some other issues.
