TRAUMATOLOGICAL EXPERTISE OF BODILY INJURIES IN CRIMINAL AND CIVIL PRACTICE

The study presents a comprehensive analysis of forensic traumatological expertise of bodily injuries within the framework of criminal and civil procedure. The research examines the clinical and diagnostic, methodological, and legal aspects of forensic medical practice that determines the reliability and evidential value of expert conclusions. Based on a systemic legal and comparative analytical approach, the study compares medical and legal criteria for assessing harm to health. It has been established that the absence of unified methodologies and standardized definitions of harm categories creates the risk of contradictory judicial decisions in the qualification of offenses and the determination of compensation. The empirical basis includes materials from forensic medical examinations and judicial practice of the Supreme Court of the Russian Federation for 2024–2025. The analysis reveals that up to 12% of expert conclusions require revision due to methodological inaccuracies and discrepancies between clinical and legal terminology. Particular attention is paid to the instrumental methods of injury documentation – computed and magnetic resonance tomography, as well as digital modeling of injuries, which ensure the results’ objectivity. The study proposes a concept for integrating medical, technical and legal procedures into a unified system of standardized traumatological expertise. The necessity of developing federal methodological recommendations that formalize the criteria for assessing the severity of injuries and introduce digital radiological documentation technologies is substantiated. The scientific novelty lies in the systematization of previously fragmented forensic medical data and in the formulation of proposals aimed at harmonizing the legal and medical foundations of expert activity. The practical significance of the work is determined by the potential application of its results in developing unified national standards for forensic medical expertise.
