RELIGIOUS TRADITIONAL AND ETHNO RELIGIOUS MODELS OF STATE AND LEGAL DEVELOPMENT OF THE MIDDLE EAST COUNTRIES IN THE POST COLONIAL PERIOD: A COMPARATIVE LEGAL ANALYSIS

The author attempts to study the systemic and typological characteristics of the state and legal development of the Kingdom of Saudi Arabia, the United Arab Emirates, the Islamic Republic of Iran and the State of Israel in the post-colonial period. Purpose: to analyze the formation and the evolution of state and legal models in the countries mentioned. Methods: the work employs the method of state and legal modelling, comparative legal, formal‑legal, systemic and historical‑legal methods. Results: two models of state and legal development have been constructed: a religious‑traditional model (Saudi Arabia, the UAE, and Iran) and an ethno‑religious one (Israel). The experience of the studied countries suggests that models can be constructed to respect religious traditions, establish national identity and implement modern forms of government.
